1. Eligibility & Enforcement1.1 Clients must be 18 years of age or older.
1.2 Any violation of these Terms will result in immediate cancellation of the commission and may result in indefinite blacklisting.
2. General Conditions2.1 The artist reserves the right to accept or decline any commission for any reason.
2.2 Commissions are not first-come, first-served (FCFS) unless explicitly stated.
2.3 Clients may not commission artwork of characters they do not own, except for:
- Fanart, or with explicit permission from the character’s owner.2.4 Commissioned artwork may NOT be used for:
- NFTs
- AI training or generation
- Generative AI purposes2.5 Commissions containing the following will NOT be accepted:
- Glorification of terrorism, hate speech, or violent extremism
- Targeted harassment of
individuals, groups, brands, or marginalized communities
- Sexualized depictions of minors or characters under 182.6 Requests for private commissions must be disclosed prior to payment and are subject to an additional NDA/privacy fee.
2.7 Commercial use must be disclosed prior to payment.
3. Payment & Refund Policy3.1 Payment is accepted exclusively via PayPal invoice (USD).
3.2 Full payment is required prior to commencement of the commission, unless a payment plan is agreed upon.
3.3 Payment must be completed within 48 hours of receiving the invoice; failure to comply will result in cancellation.
3.4 Payment plans may be requested only for commissions over $300 and must be approved before work begins.
3.5 Commission cancellation:
- If canceled by the artist: full refund regardless of progress.
- If canceled by the client:
- Full refund if work has not started
- Partial refund based on completed work
- No refunds once the artwork is fully completed
4. Progress, Revisions & Delivery4.1 Estimated completion time: 3 weeks to 3 months, depending on workload and health.
4.2 Clients will be notified of delays as they arise.
4.3 Deadlines must be disclosed prior to payment; rush fees may apply.
4.4 Clients are provided one (1) work-in-progress (WIP) unless additional WIPs are explicitly agreed upon.
4.5 No WIPs or revisions for Skeb-style or Your Character Here (YCH) commissions.
4.6 Client failure to respond within 48 hours permits the artist to continue work without additional input.
4.7 Final files will be delivered via email download link (full-resolution PNG).
4.8 Completed artwork may be posted publicly with client credit unless private arrangements were agreed.
4.9 All artwork is glazed and night-shaded to deter generative AI misuse.
5. Communication5.1 All commission communication is conducted via email.
5.2 Discord server commissions are FCFS and follow instructions provided in announcements.
5.3 Commission requests are responded to within seven (7) days unless a specific response date is posted.
5.4 Requests with no reply after seven days are considered declined, and no separate rejection notice will be sent.
5.5 Clients must not spam emails, social media posts, or comments requesting commission updates.
6. Rights & Usage6.1 Artist Rights
6.1.1 The artist retains full copyright and ownership of all commissioned artwork.
6.1.2 The artist may publicly display the artwork, including:
- Social media posts
- Portfolio display
- Subscription platforms (e.g., Patreon)6.1.3 The artist will not sell or merchandise the artwork without explicit agreement with the client.6.2 Client Rights & Permitted Use
6.2.1 The client retains ownership of their original character and design.
6.2.2 Permitted personal-use actions include:
- Cropping the artwork for personal layouts (icons, banners, headers), provided the artwork is not edited or altered and not associated with any brand
- Posting the artwork on personal social media
- Sharing the artwork non-commercially
- Providing credit to the artist wherever the artwork is displayed6.2.3 Prohibited actions (violation may result in termination and blacklisting):
- Use of artwork for AI generation or AI-assisted purposes
- Reproducing, selling, licensing, or profiting from the artwork without written consent
- Claiming authorship or creation of the artwork
- Removing, altering, or obscuring watermarks or signatures without permission
- Editing, tracing, or otherwise altering the artwork
- Modifying the artwork in unapproved ways, including background removal, meme generation, or unauthorized filters6.2.4 Commercial Rights
- Personal commissions do not include commercial rights by default
- Commercial usage must be approved prior to payment
- Commercial rights may be purchased starting at $100 USD, with pricing adjusted based on scope and intended use6.2.5 If a client is uncertain about permitted use, they must contact the artist for prior approval.
